Terms & Conditions This page was last updated on November 10, 2005, and provides the terms and conditions governing the submission of materials for publication by The News Council, a Delaware Corporation. Room 301 Washington, D.C. 20007-4132 Contact: WashingtonDC@NewsCouncil.org The purpose of The News Council and the Sites is to provide, among other things, to provide a way for public affairs professionals, public relations executives and public relations service bureau professionals a way to contact one another to do business. If you submit materials for networking with The News Council or use (such as by reading or posting information on) any of the Sites, you are using The News Council Services (the "Services"). By using the Services, you agree to the terms and conditions set forth in this agreement. If you do not agree to these terms, please do not use the Services. Over time, we may make changes to the terms of this agreement thereby altering the terms and conditions governing the use of the Services. For users of The News Council, the version of this agreement that is posted on this website on the date you sign up will govern your submission of materials for networking with The News Council. For users of the Sites, if we make any changes affecting the use of the Sites, we will notify you by posting the item prominently on this webpage and/or on one or all of the Sites. If you continue to use the Sites after a change has been posted, you agree to conform your use of the Sites to that change. If you do not want to agree to a change we make, we ask that you stop using the Sites at that time. When submitting materials for networking with The News Council, please act responsibly and be respectful of other users and contributors. Some of the material that may be published by The News Council and posted on the Sites is protected by copyrights, trademarks and other intellectual property laws. Therefore, you may not copy, transmit, distribute (including by e-mail or other electronic means), sell, make changes or otherwise reproduce any materials from The News Council or the Sites without the prior consent of the owner. However, you can make photocopies of small portions of The News Council and print or download information from the Sites as long as you only use that information for your own personal, non-commercial use. Whether you are submitting material for networking with The News Council or on one of our Sites, you represent and warrant that such material (i) is true and accurate at the time of your submission; and (ii) does not and shall not violate or infringe any common law or statutory right of any person or other entity including, without limitation, any contractual rights, proprietary rights, trademark, service mark, copyright or patent rights, or any rights of privacy or publicity, and that such material is not threatening or libelous, does not violate any law or regulation, and does not contain any instructions, recipes or formulas that, if implemented, would result in injury. In addition, by submitting a information for display on one of our Sites, you represent and warrant that you have the right and authority to distribute the information on behalf of the person or entity about whom the information relates. In addition, when registering to use any of our Sites or using a password in connection with one of our Sites, we ask that you do not use a false user name or identity or let others use your user name and password. Each person is responsible for the actions that are taken under his or her user name and password. We retain the right to deny access to our Sites to anyone who we believe has violated these terms or any other term of this agreement. We do not review, endorse, or investigate the participants in The News Council or other listings that are posted or included on the Sites and, thus, we cannot promise the information contained in the advertising, postings or listings is reliable or accurate or that the information does not infringe or violate any laws. We also cannot guarantee that the files or information that you may download from the Sites do not have harmful features, such as viruses. If you download any materials from any of the Sites or rely solely on the information in The News Council, you do so at your own risk. We reserve the right (but assume no obligation) to delete, move, or edit any postings in The News Council that come to our attention that we consider unacceptable or inappropriate, whether for legal, or other reasons. In addition, when you submit material to The News Council, you are permanently granting us all rights to the material, including the right to reproduce and publish the material on the Sites, to modify the material, to use it commercially, and to maintain the material in an archive in any medium. Without the prior written permission of The News Council Corporation, you may not frame any of the content on the Sites, or incorporate into another website or other service any intellectual property The News Council. Requests for permission to frame the content on our Sites may be sent to WashingtonDC@NewsCouncil.Org. Because of the number of possible sources of information available through The News Council, and, with respect to the Sites, the inherent hazards and uncertainties of electronic distribution, there may be delays, omissions, inaccuracies, or other problems with such information. UNDER NO CIRCUMSTANCES SHALL THE NEWS COUNCIL CORPORATION OR ITS AFFILIATES, AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES OTHER THAN DIRECT DAMAGES. THIS PROVISION INCLUDES, WITHOUT LIMITATION, ANY LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, AND INDIRECT OR SIMILAR DAMAGES, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. YOU AGREE THAT THE LIABILITY OF THE NEWS COUNCIL CORPORATION AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY CONNECTED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE NEWS COUNCIL CORPORATION FOR THE USE OF THE SERVICES |
